{"id":1094,"date":"2026-03-30T10:13:13","date_gmt":"2026-03-30T10:13:13","guid":{"rendered":"https:\/\/gold-tapir-911468.hostingersite.com\/index.php\/2026\/03\/30\/a-war-without-accountability-why-the-middle-east-crisis-is-also-a-legal-quagmire\/"},"modified":"2026-04-07T10:42:27","modified_gmt":"2026-04-07T10:42:27","slug":"a-war-without-accountability-why-the-middle-east-crisis-is-also-a-legal-quagmire","status":"publish","type":"post","link":"https:\/\/the-secularist.com\/index.php\/2026\/03\/30\/a-war-without-accountability-why-the-middle-east-crisis-is-also-a-legal-quagmire\/","title":{"rendered":"A war without accountability: why the Middle East crisis is also a legal\u00a0quagmire"},"content":{"rendered":"<p>What began with surprise US and Israeli strikes on Iran one month ago has hardened into a grinding stand-off, with no clear way out.<\/p>\n<p>The conflict\u2019s opening blows on <a style=\"color: blue;\" href=\"https:\/\/www.bbc.com\/news\/articles\/c4g0pnnj8xyo\">February 28<\/a> killed senior leaders in Tehran, <a style=\"color: blue;\" href=\"https:\/\/www.cbsnews.com\/news\/cia-intelligence-us-israel-strike-ayatollah-ali-khamenei-iran\/\">including Supreme Leader Ali Khamenei<\/a> \u2013 prompting <a style=\"color: blue;\" href=\"https:\/\/www.aljazeera.com\/news\/2026\/3\/18\/iran-fires-missiles-drones-across-gulf-region-remains-in-war-crosshairs\">retaliatory missile and drone attacks<\/a> on Israel, US bases and Gulf infrastructure.<\/p>\n<p>Years of tension over <a style=\"color: blue;\" href=\"https:\/\/www.bbc.com\/news\/articles\/c309vz0z893o\">Iran\u2019s nuclear programme<\/a> and its regional influence have now boiled over into open warfare, with diplomacy faltering as both sides entrench their positions.<\/p>\n<p>On the ground in Iran, the violence is worsening what was already a strained <a style=\"color: blue;\" href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2026\/03\/un-expert-warns-deepening-human-rights-crisis-iran\">human rights situation<\/a>. News reporting from within the country carries daily images of damaged neighbourhoods, overwhelmed hospitals and families fleeing tit-for-tat strikes.<\/p>\n<p>One incident in particular \u2013 the <a style=\"color: blue;\" href=\"https:\/\/news.un.org\/en\/story\/2026\/03\/1167138\">US airstrike on a school in Minab<\/a> in southern Iran that left dozens of girls dead \u2013 highlights the scale of the devastation, as well as the war\u2019s murky legal context.<\/p>\n<p>Future war crimes investigators will need to ask some obvious questions. Was the school a civilian site, was it used for military purposes, what precautions were taken and was the civilian harm excessive relative to any military advantage?<\/p>\n<p>Only then will responsibility be able to be determined \u2013 but such clarity is likely to be a long way off.<\/p>\n<h2>When the law is clear, but accountability is not<\/h2>\n<p>Many observers have <a style=\"color: blue;\" href=\"https:\/\/www.justsecurity.org\/134290\/us-article-51-letter-united-nations\/\">already criticised<\/a> the shaky legal basis for the conflict.<\/p>\n<p>Some have described the US position \u2013 as set out in <a style=\"color: blue;\" href=\"https:\/\/www.justsecurity.org\/wp-content\/uploads\/2026\/03\/US-Article-51-letter-Iran-11-March-2026.pdf\">a letter<\/a> to the United Nations invoking self-defence and the protection of Israel against an alleged imminent threat from Iran and its allied groups \u2013 as thin.<\/p>\n<p>Others <a style=\"color: blue;\" href=\"https:\/\/theconversation.com\/neither-preemptive-nor-legal-us-israeli-strikes-on-iran-have-blown-up-international-law-277173\">have argued<\/a> that strikes supporting the stated goal of regime change were unlawful, citing the UN Charter\u2019s prohibition on the use of force against the political independence of a state and the principle of non-intervention.<\/p>\n<p>At this point, it is safe to assume that accountability for alleged international crimes by all sides to this ongoing conflict will remain elusive.<\/p>\n<p>The <a style=\"color: blue;\" href=\"https:\/\/www.icc-cpi.int\/\">International Criminal Court<\/a> has no automatic jurisdiction because the United States, Israel and Iran are not parties to the <a style=\"color: blue;\" href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2024-05\/Rome-Statute-eng.pdf\">Rome Statute<\/a>, the treaty that established the court and defines its powers.<\/p>\n<p>A <a style=\"color: blue;\" href=\"https:\/\/www.icc-cpi.int\/about\/how-the-court-works\">UN Security Council referral<\/a> of the situation to the court for investigation and possible prosecution is also unlikely, given the high potential for any such move to be blocked by veto-wielding permanent members.<\/p>\n<p>Is any accountability likely to come through internal investigations by the states involved? This too is uncertain, as such investigations are often classified or <a style=\"color: blue;\" href=\"https:\/\/www.icrc.org\/sites\/default\/files\/document\/file_list\/guidelines_on_investigating_violations_of_ihl_final.pdf\">narrowly framed<\/a> by military and legal authorities.<\/p>\n<p>This means independent investigators are often left to piece together their cases from <a style=\"color: blue;\" href=\"https:\/\/syriaaccountability.org\/mass-graves-using-satellite-imagery\/\">satellite imagery<\/a>, authenticated videos, mass graves, weapon remnants and medical and mortuary records.<\/p>\n<p>While this can establish what happened and where, <a style=\"color: blue;\" href=\"https:\/\/international-review.icrc.org\/articles\/reports-and-documents-ihl-and-the-challenges-of-contemporary-armed-conflicts-927\">linking harm<\/a> to identifiable decision-makers and proving intent is far harder while the conflict continues and key military records remain sealed.<\/p>\n<p>This is not to say the laws of war themselves are ambiguous. They require forces to <a style=\"color: blue;\" href=\"https:\/\/casebook.icrc.org\/law\/principle-distinction\">distinguish<\/a> between civilians and fighters, &lt;astyle=&#8221;color:blue;&#8221; href=&#8221;https:\/\/ihl-databases.icrc.org\/en\/customary-ihl\/v1\/rule15&#8243;&gt;avoid excessive civilian harm and take practical precautions.<\/p>\n<p>International criminal cases turn on attribution and intent, meaning investigators must show who authorised an attack and what they knew. But without insider witnesses or key evidence, that is difficult, and proper accountability for war crimes often fall short.<\/p>\n<h2>A pattern of impunity?<\/h2>\n<p>We have seen this pattern before, where efforts to secure accountability are blocked or weakened by international deadlocks.<\/p>\n<p>In 2014, the UN Security Council <a style=\"color: blue;\" href=\"https:\/\/press.un.org\/en\/2014\/sc11407.doc.htm\">attempted<\/a> to refer alleged war crimes and crimes against humanity against civilians in Syria\u2019s civil war to the ICC. The effort failed after Russia and China vetoed it, citing concerns about sovereignty and the impact on a political settlement.<\/p>\n<p>In 2021, the UN Human Rights Council <a style=\"color: blue;\" href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2021\/10\/statement-group-experts-yemen-hrc-rejection-resolution-renew-their-mandate\">ended the mandate<\/a> of the Group of Eminent Experts on Yemen \u2013 an independent body tasked with investigating and reporting on violations by all parties \u2013 after some member states voted against renewing it. This removed one of the international community\u2019s few mechanisms for documenting human rights abuses.<\/p>\n<p>The ongoing crisis in Gaza has also proved a defining test of whether international law can be enforced.<\/p>\n<p>The ICC has opened an investigation <a style=\"color: blue;\" href=\"https:\/\/www.icc-cpi.int\/palestine\">into Palestine<\/a> and issued arrest warrants for senior Israeli and Hamas officials over alleged war crimes and crimes against humanity.<\/p>\n<p>But such warrants depend on states to enforce them, and cooperation has been limited. A parallel UN inquiry <a style=\"color: blue;\" href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/hrbodies\/hrcouncil\/sessions-regular\/session60\/advance-version\/a-hrc-60-crp-3.pdf\">has found<\/a> Israel has committed genocide, yet the path to legal accountability remains contested.<\/p>\n<p>In Iran, a similar outcome \u2013 or lack of one \u2013 now appears sadly likely.<!-- Below is The Conversation's page counter tag.
